Terms of Service
These Terms of Service ("Terms") constitute a legally binding agreement between GB HOST ("Company", "we", "us", or "our"), a web hosting service provider registered in Bangalore, Karnataka, India, and you ("Customer", "you", or "your"), governing your use of our services.
1. Acceptance of Terms
By accessing or using GB HOST services, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations of India, including but not limited to:
- The Information Technology Act, 2000 and its amendments
- The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021
- The Indian Contract Act, 1872
- The Consumer Protection Act, 2019
- Digital Personal Data Protection Act, 2023 (when enforced)
2. Services Offered
GB HOST provides the following services:
- Web Hosting: Shared, VPS, Dedicated, and Cloud hosting solutions
- Domain Registration: Domain name registration and management services
- Email Services: Professional email hosting and management
- SSL Certificates: Security certificate provisioning
- Website Builder: Tools for website creation and management
- Technical Support: 24/7 customer support services
3. Account Registration
3.1 Eligibility
You must be at least 18 years of age and legally capable of entering into binding contracts under Indian law. If you are registering on behalf of an organization, you represent that you have the authority to bind that organization.
3.2 Account Information
You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security of your password and account
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
3.3 KYC Compliance
In accordance with Indian regulations, we may require additional verification documents including:
- Government-issued photo identification (Aadhaar, PAN, Passport, Driving License)
- Address proof
- GST registration (for business accounts)
4. Service Usage and Restrictions
4.1 Acceptable Use
You agree not to use our services for any unlawful purpose or in violation of these Terms. Prohibited activities include but are not limited to:
- Violating any Indian laws or regulations
- Hosting or distributing malware, viruses, or harmful code
- Engaging in phishing, fraud, or identity theft
- Hosting content that infringes intellectual property rights
- Distributing obscene, defamatory, or harmful content
- Mining cryptocurrency without explicit permission
- Running unauthorized game servers or peer-to-peer applications
- Sending spam or unsolicited bulk emails
- Attempting to gain unauthorized access to any systems
4.2 Resource Usage
Shared hosting accounts are subject to resource limitations. Excessive use of server resources including CPU, memory, or bandwidth may result in:
- Temporary suspension of services
- Request to upgrade to a higher plan
- Additional charges as per current rates
5. Payment Terms
5.1 Pricing and Billing
- All prices are listed in Indian Rupees (INR)
- Prices are subject to applicable GST (currently 18%)
- Services are billed in advance on a monthly, quarterly, annual, or biennial basis
- Renewal charges are based on the then-current rates
5.2 Payment Methods
We accept the following payment methods:
- Credit/Debit Cards (Visa, MasterCard, RuPay)
- Net Banking
- UPI (Unified Payments Interface)
- Digital Wallets (Paytm, PhonePe, Google Pay)
- Bank Transfer/NEFT/RTGS/IMPS
5.3 Late Payment
If payment is not received within 7 days of the due date:
- Services may be suspended
- A late fee of ₹500 or 5% of the invoice amount (whichever is higher) may apply
- After 30 days, accounts may be terminated and data deleted
6. Domain Name Registration
6.1 Domain Ownership
You retain ownership of domain names registered through our services. We act solely as a registrar intermediary.
6.2 Domain Renewal
- Domain renewal notices will be sent 60, 30, and 7 days before expiration
- Failure to renew may result in domain loss
- Redemption period charges may apply for expired domains
7. Data Backup and Security
7.1 Customer Responsibilities
You are responsible for maintaining your own backups. While we perform regular server backups, we do not guarantee restoration of lost data.
7.2 Security Measures
We implement industry-standard security measures including:
- Firewall protection
- DDoS mitigation
- Regular security updates
- SSL encryption
- 24/7 server monitoring
8. Service Level Agreement (SLA)
8.1 Uptime Guarantee
We guarantee 99.9% uptime for all hosting services, calculated monthly. This excludes:
- Scheduled maintenance (notified 48 hours in advance)
- Force majeure events
- Issues caused by customer actions
- DDoS attacks or similar malicious activities

9. Intellectual Property Rights
9.1 Customer Content
You retain all rights to content you upload to our servers. You grant us a limited license to host and serve your content as necessary to provide our services.
9.2 Our Property
All GB HOST trademarks, service marks, logos, and proprietary software remain our exclusive property.
10. Suspension and Termination
10.1 Suspension
We may suspend services immediately if:
- You violate these Terms or Acceptable Use Policy
- Payment is overdue
- Required by law enforcement or court order
- Your account poses a security risk
10.2 Termination
Either party may terminate services with 30 days written notice. Immediate termination may occur for material breach of these Terms.
11. Limitation of Liability
To the maximum extent permitted by Indian law:
- Our total liability shall not exceed the amount paid by you in the preceding 12 months
- We are not liable for indirect, incidental, or consequential damages
- We are not responsible for third-party actions or content
12. Indemnification
You agree to indemnify and hold GB HOST harmless from any claims, damages, losses, or expenses arising from:
- Your use of our services
- Violation of these Terms
- Infringement of third-party rights
- Your content or activities
13. Dispute Resolution
13.1 Governing Law
These Terms are governed by the laws of India.
13.2 Arbitration
Any disputes shall be resolved through arbitration under the Arbitration and Conciliation Act, 2015. The arbitration shall be conducted in Bangalore, Karnataka, in English.
13.3 Jurisdiction
Subject to arbitration, courts in Bangalore, Karnataka shall have exclusive jurisdiction.
14. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Continued use of services constitutes acceptance of modified Terms.
